Per Politico Pro, a group of 31 states is asking the EPA to delay the effective date of the Clean Water Rule to give the court time to review the legal arguments raised against the rule.
In a letter to EPA Administrator Gina McCarthy and Assistant Secretary of the Army Jo-Ellen Darcy, the states argue that “a federal regulation of this scope and significance demands a thorough judicial review” before it takes effect. While a federal court is reviewing claims from the states and other groups, it has yet to issue a ruling on a preliminary injunction.
The states ask for the EPA to extend the effective date by “at least nine months.”
