The House Small Business Committee is joining the growing chorus of groups calling on the Environmental Protection Agency (EPA) to withdraw its proposed Clean Water Act rule defining “waters of the United States,” arguing that the measure would be bad for small business, according to a Politico report.

In a letter that is expected to be sent today to EPA Administrator Gina McCarthy and Jo-Ellen Darcy, head of the Army Corps of Engineers, 14 committee members argue the administration has not taken appropriate steps to prevent economic side effects, particularly in not doing a Regulatory Flexibility Act assessment for the rule. “To the extent that the agencies attempted to assess the economic impact on small businesses, it did so in a manner that limited the potential costs on small businesses,” which appears to circumvent requirements of the law, the representatives argue. The letter is available here.
